Very often when clients come here, they ask if their spouse’s signature is required to obtain a divorce in New York State. The truth of the matter is that a divorce does require often two signatures. However, in cases where there’s a default and the other spouse does not show in the divorce, the other person’s signature is not required and a New York State Supreme Court can issue a divorce.

However, in cases where both spouses are present and participating in the divorce, both spouses are needed to negotiate that divorce, and their signatures are both needed to finalize the divorce.
